1. Agreement to Terms

By accessing or using Serenade ("the Service"), operated by Synthweave ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Serenade is an AI-powered platform that creates personalized songs based on user input. The Service uses artificial intelligence to generate original music and lyrics tailored to your specifications. Songs are generated for personal, non-commercial use unless otherwise agreed upon in writing.

3. Account Registration

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Promptly update your information if it changes
• Accept responsibility for all activity that occurs under your account
• Notify us immediately of any unauthorized use of your account

4. Pricing and Payments

Serenade offers personalized songs on a per-song basis. Pricing starts at $29 for a Standard song and $49 for a Premium song. All purchases are processed securely through Stripe. Prices are subject to change with reasonable notice.

If you are not satisfied with your song, contact us within 14 days for a full refund or a free remake — no questions asked.

5. Intellectual Property

Your Content: You retain ownership of any input, prompts, or personal stories you provide to the Service. By submitting content, you grant us a limited license to process it for the purpose of generating your song.

Generated Songs: Songs generated through the Service are provided to you with a personal, non-exclusive license for personal use. You may share generated songs with friends and family. Commercial use of generated songs requires a separate commercial license.

Platform IP: The Serenade platform, its design, underlying technology, and branding are the exclusive property of Synthweave and are protected by intellectual property laws.

6. Acceptable Use

You agree not to use the Service to:

• Generate content that is hateful, threatening, harassing, or promotes violence
• Create songs that infringe on the intellectual property rights of others
• Impersonate any person or entity
• Attempt to reverse-engineer, decompile, or extract the AI models
• Use automated scripts, bots, or scrapers to access the Service
• Circumvent any access controls or usage limits
• Generate content that exploits or harms minors in any way

We reserve the right to remove content and suspend accounts that violate these guidelines.

7. Content Safety

Serenade employs content safety measures to prevent the generation of harmful, offensive, or inappropriate content. We may refuse to generate songs that violate our content guidelines. Our safety systems are continually updated, and we reserve the right to modify content policies at any time.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. Song generation times may vary based on demand and system capacity. We reserve the right to perform maintenance, updates, or modifications that may temporarily affect availability. We are not liable for any downtime or service interruptions.

9. Limitation of Liability

To the maximum extent permitted by law, Synthweave and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will meet your requirements, be error-free, or that generated songs will be suitable for any particular purpose.

11. Termination

We may suspend or terminate your account at our discretion if you violate these Terms. You may delete your account at any time through your account settings. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will remain in effect.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on the Service and updating the "Last updated" date. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts located in Delaware.
